Bicycle and motorcycle accidents can be caused by factors beyond your control. One common trick played by insurance companies is to claim that a personal injury victim’s injuries were “pre-existing” and therefore, their insured is not responsible for any damages. In truth, there are seldom any true cases involving “pre-existing injuries” when that term is given its plain and ordinary meaning.
A true “pre-existing injury” is one that already exists and was not affected by a new occurrence. Thus, if I already had a fractured leg and was involved in a RI car accident, my lawyer could not claim the fractured leg was caused in the car accident. This is so obvious that it almost never occurs.

Rather, consumers need to understand that simply because they have a past injury does NOT prevent them from retaining a RI personal injury lawyer and filing a claim for a personal injury. In fact, it is your right to do so.

Every first year law student learns about the “eggshell plaintiff doctrine” in his or her Torts class. The law recognizes that a pre-existing injury could make you more likely to suffer from an additional injury, even from a relatively mild collision. By law, the victim of an automobile collision must be accepted in the condition they were at the time of the collision. This means the person or people responsible for an automobile collision are fully liable for all injuries sustained by the victim, no matter how unforeseeable such injuries might be. Car accident attorneys refer to this as the “Eggshell Plaintiff” or “Eggshell Skull” principle, based on the idea that a theoretical victim’s condition may be so fragile that the slightest contact caused substantial injury to the victim. This concept applies to mental as well as physical injuries such as considering impact of an assault on Vietnam veteran’s post-traumatic stress syndrome.

Thus, consumers should know that insurance companies are fully liable for their insured’s negligence that causes an aggravation or exacerbation of a pre-existing injury.

Also, the Eggshell Plaintiff principle only pertains to the damages a personal injury victim may recover. The Eggshell Plaintiff principle does not affect the standards for liability when determining fault for the automobile accident.

Yaydığı koku yüzünden vatandaşların şikayetine neden olan gemi Kent Konseyi üyeleri tarafından protesto edildi. Ancak ilçe esnafı ve özellikle deri konfeksiyoncuları, gemi personelinin alışveriş için Bandırma’ya çıkmasına sevindi.

İSTANBUL - TAV Havalimanları Holding'in yolcu sayısı Kasım ayında yüzde 41 artışla 5.92 milyon olurken, ilk 11 aylık dönemde yüzde 36 artışla 66.2 milyona ulaştı.
TAV Havalimanları Holding'den yapılan açıklamaya göre, Kasım ayında uluslararası yolcu sayısı yüzde 36 artışla 3.37 milyona, yurtiçi yolcu sayısı ise yüzde 49 yükselişle 2.55 milyona çıktı.
TAV'ın işlettiği en büyük havalimanı olan Atatürk Havalimanı'ndaki yolcu sayısı ise Kasım ayında yüzde 20 artarak 3.7 milyon olurken, Ocak-Kasım döneminde ise yüzde 20 artışla 41.45 milyona ulaştı.
Son 12 ayda TAV Havalimanları'nın hizmet verdiği yolcu sayısı ise yüzde 21 artışla 44.46 milyona yükseldi.

İstanbul’daki 3. Havalimanı projesinin ihalesi için çalışmalar hızlandırılırken, uzmanlar Rekabet Kurumu’nun ihale sürecinde yapacağı analiz detaylarını ortaya çıkardı.



İSTANBUL - Yap – işlet - devret modeli ile yapılması planlanan ve 2013 yılı bitmeden ihalesi tamamlanması hedeflenen İstanbul’a 3. Havalimanı projesinde çalışmalar hızlandırıldı. Karadeniz sahiline kurulmasına karar verilen 3. Havalimanı için 120 milyon yolcu kapasitesi hedeflenirken, ihale sürecini yakın takibe alan ACTECON Rekabet ve Regülâsyon Danışmanlık firması, Rekabet Kurumu’nun ihale sürecinde gerçekleştireceği analiz detaylarını ortaya çıkardı.

Coğrafi Pazar ve Rekabet Analizi’ni kapsayan inceleme neticesinde tekel (hakim durum) olgusuna dikkat çeken ACTECON firmasının ortağı Şahin Ardıyok, başta THY olmak üzere birçok havayolu şirketinin 3. Havalimanı’nda terminal işletmeciliğine girerek dikey entegrasyon ile maliyetlerini düşürebileceklerini kaydederek, “Özellikle yer hizmetleri şirketi TGS ve catering hizmetleri şirketi Do&Co’da yüzde 50 hissesi olan Türk Hava Yolları’nın (THY) 3. Havalimanı ihalesine katılacak olan şirketleri, diğer özelleştirme süreçlerinde olduğu gibi, Coğrafi Pazar ve Rekabet konularında analiz edecek. İstanbul’daki 3 havalimanının birbirleri ile rekabet edebilmesi için en uygun şartlar belirlenecek. Eğer elinizde birbiriyle rekabet edebilecek üç havaalanı varsa, doğru çözüm düşük fiyat ve yüksek kalite için bunları farklı ellerde tutmaktır. Uzman ekibi ile Rekabet Kurumu’nun ihale sürecinde yapacağı analizleri gerçekleştirdiklerini ifade eden Şahin Ardıyok, Antalya’da TAV’ın kazandığı Gazipaşa Havalimanı ihalesini baz aldıklarını söyledi. Şahin Ardıyok, “Gazipaşa Havalimanı’nın Coğrafi Pazar Analizi yapılırken etrafında bulunan Antalya, Isparta, Burdur, Bodrum ve Dalaman havalimanları incelendi. Rekabet Analizi’nde ise Gazipaşa Havalimanı’nın işletmeye açılması halinde hangi havalimanları ile rekabet edeceği masaya yatırıldı. Bodrum ve Dalaman havalimanlarının kara yolu uzaklığı ve konfor problemleri nedeniyle Antalya için rakip olamayacağına karar verilirken, Isparta ve Burdur havalimanlarının ise küçük kapasiteli olmaları rekabet açısından elenmesine neden oldu. 150 kilometre uzaklıktaki Antalya Havalimanı’nın en güçlü rakip olduğuna karar veren Rekabet Kurumu, hakim durum olgusu nedeni ile bu havalimanı işletmecisi şirketin ihaleye girip girmediğini araştırdı. İhaleye girmediği belirlenince de en yüksek teklifi veren TAV’ın Gazipaşa Havalimanı’nın işletme hakkını almasına onay verdi” diye konuştu.

Havalimanı ihalesini almasının en çok da THY’yi yakından ilgilendirdiğini ifade eden Şahin Ardıyok, ”İstanbul eğer çok büyük transit bir merkez haline gelecek ise, havaalanları arasındaki rekabetin istenen düzeyde olmaması THY’nin de işine gelmeyecektir. Bu doğrultuda THY’nin de 3. Havalimanı ihalesine girebilmesi muhtemeldir. THY’nin yer hizmetlerinde TGS’de catering hizmetlerinde ise Do & Co şirketinde yüzde 50 ortaklığı var. Bu iki alanda zaten var olan THY 3. Havalimanı ihalesine de girerek havalimanı işletmeciliğine de soyunabilir” dedi.

TAV AHL işletmesini devredebilir
İstanbul’un gerek konumu gerekse de işlevselliği açısından önemli bir destinasyon olduğunu hatırlatan Şahin Ardıyok, “İstanbul dahil olduğu coğrafi pazar Anadolu ve Avrupa yakası ile Trakya bölgesinden oluşuyor. Coğrafi pazarı Avrupa yakası olarak aldığımızda AHL ve 3. Havalimanı bu kapsamda değerlendiriliyor. Dolayısıyla da Sabiha Gökçen Havalimanı bu kapsamın dışında kalıyor. Ancak buradaki sorun şu; eğer 3. Havalimanı’nı AHL işletmecisi alırsa, o zaman da devreye hakim durum olgusu giriyor ki, Rekabet Kurumu’nun bu neticeye onay vermesi zorlu bir süreci beraberinde getiriyor. Coğrafi pazar Avrupa ve Anadolu yakası olarak baz alındığında ise o zaman Sabiha Gökçen Havalimanı da işin içine giriyor ve kapsam genişliyor. Bu kez de ortaya rekabet unsuru çıkıyor” diye konuştu. Rekabet Analizi ile havalimanları arasındaki fiyat politikasının incelendiğini açıklayan Şahin Ardıyok, “İstanbul’da AHL işletmecisinin ihaleyi alması halinde yer hizmetlerinde ve diğer işletme konularında ne tip bir fiyat politikası izleneceği Rekabet Analizi’nin temel konusu. Bunun yanı sıra Sabiha Gökçen Havalimanı üzerinde bir rekabet baskısı oluşabilir mi? Bu da çok önemli. İncelemeler neticesinde Rekabet Kurumu’nun yine hakim durum olgusu nedeni ile AHL işletmecisine onay vermemesi söz konusu olabilir” dedi. AHL işletmecisi şirketin mevcut havalimanını 2021’e kadar işletme hakkı bulunduğunu hatırlatan Şahin Ardıyok, “3. Havalimanının 2017’de devreye girmesi planlanıyor. AHL işletmecisi şirket, eğer isterse 4 yıl önceden AHL işletmesini devretmeyi taahhüt ederek, ihaleye daha ciddi bir alıcı olarak dahil olabilir” dedi.
THY'nin yeterliliği yok
Öte yandan, açıklamayla ilgili Dunya.com'a yorum yapan, havaalanı işletmeciliği konusunda uzman bir hukukçu, THY'nin mevcut iştirakleriyle ihaleye girmek için yeterliliği olmadığını söyledi. İstanbul'a yapılması planlanan 3'üncü havalimanı ölçeğinde bir tesisin işletmesine talip olabilmek için THY'nin mutlaka bu yeterliliğe sahip bir ortaklığa dahil olması gerektiğine işaret etti.
İşletmeye açıldığında dünyanın en büyük havalimanlarından biri olması muhtemel üçüncü havalimanı için ihale şartnamesinin bu yıl sonuna yetişmesinin zor olduğunu ifade eden hukukçu, şartların 2013'ün ilk yarısında belli olacağını tahmin ettiklerini belirtti.
İhaleye Avrupa'dan, ABD'den ve Ortadoğu'dan havaalanı işletmeciliği konusunda uluslararası tecrübeye sahip dünya devi şirketlerin ilgi göstermesi bekleniyor.

KARADENİZ’de dün patlayan fırtına Şile’den 10 mil açıkta Volgo-Balt 199 yük gemisi birkaç dakika içinde batırdı. Şile’den yardıma gitmeye çalışan Kıyı Emniyeti’nin 7 numaralı botu da sürüklenerek Şile Mendireği’ne çarparak parçalandı. Botun kaptanı Cemil Özben, Yağcı Turgay Sarıboğa, Çarkçı Mehmet Genç ile yardıma giden balıkçı Mümin Akgün hayatlarını kaybetti. Botun önünde demir atmaya çalışan denizci Ahmet Kotaracı ise kayalıklara düşerek hayatta kaldı. Hayatını kaybeden gemicilerin yakınları, personelin zorla denize çıkartıldığını iddia etti. Kıyı Emniyeti Genel Müdürü ise "Personelin can yeleği giymeleri gerekiyordu. Olmadı. Can yeleği giymemişlerdi." dedi.

Biz denizde can ve mal kurtarıyoruz. Temel görevimiz bu. Herkesin kötü havalardan kaçtığı, sığındığı zamanlarda biz bu havaya çıkarak onlara yardım etmek için varız. Varlık sebebimiz bu. Arkadaşlarım 1500 kişinin üzerinde insan kurtarmışlar. Bunları kurtarırken de aslanlar gibi, her türlü olaya canla başla fedakarca müdahale etmişler. Bu müdahaleler sırasında mutlaka bağlı olduğu birimle bağlantı halinde, onlarla görüşerek konuşarak bu işleri yapmışlar.
HAVA ŞARTLARI MÜSAİT GÖRÜNÜYORDU
Dünkü hava şartlarına baktığımızda hem Kilyos tarafında, hem diğer tarafta yaşanan olayda her ikisinde de müdahale etmek zorunda olduğumuz bir süreci yaşadık. Hava raporuna baktığımızda 3-5’di. Olay Şile’nin açığında, çok yakın. Zaten daha öncesinde de Şile’ye böyle bir botu konuşlandırmanın amacı, oralarda böyle bir olay olduğunda İstanbul’dan oraya yetişene kadar insanları kaybetme riskiniz var. Bu süreci yaşarken olay noktasına mevcut botun daha hızlı gitme şansı olduğunu arkadaşlarımız değerlendirdi. Orada bulunan ekiple de paylaştılar. Planlamaya baktığınız zaman, o havada dışarıda çalışan aynı özellikteki 1 numaralı bot 4 kişiyi kurtarıyor. O kişilerin uzun zaman denizde kalmaması lazım. Kurtarma standartlarına göre, mantığına göre. İç kanama olabilir. Farklı bir durum yaratabilir. Onların sahile bırakılması gerekiyor. Bu meyanda da helikopterle de irtibat halinde. Olası yeni bir kişi varsa, ona da yakın olmamız gerekiyor. O sırada sahil güvenlikten de ihbar geldi birileri var diye. Doğal olarak iki bot, iki tane daha romörkör çıkarttık. Şile’de de birkaç deneme yapıldı.

DEV DALGALAR BÖYLE VURDU

Arkadaşlarımız Şile’deki teknenin çarkçısıyla, kaptanıyla değerlendirmişler. Bir şekilde de oradan çıkarak operasyona katılabileceğini değerlendiriyor. Bunu kaptanla konuşuyorlar. Kaptan da çıkıp birkaç deneme yapıyor. Ondan sonra da gidemeyeceğini söylüyor. Bu tip olaylarda tüm ekiplerimiz stand-by beklerler. Cemil Kaptan’ın ekibi de teknenin ikinci ekibi. Farklı bir yerden gelen bir ekip değil. Aklınıza gelen bir kişiyi başka bir yere vermek gibi bir şey olmaz. Arkadaşlarımız Cemil Kaptan’la da konuşuyorlar. Daire başkanımız “Tüm inisiyatif sende. Bak değerlendir. Yapabileceğin bir durumsa yap. Dışarıdaki kişiler senden kurtarılmayı bekliyor. Sen de kendi personelinle görüş. Teknede can mal emniyetini düşün buna göre hareket et” diye konuştu. Biraz da gözü kara olarak biliniyor Cemil Kaptan. Bu süreç içerisinde herhalde o da deneyeyim demiş. Deneme sonucunda da maalesef anlamadığımız bir nedenle olmuş. Gemi kaptanı planlaması gerekiyordu. Can yeleği giymeleri gerekiyordu. Olmadı. Can yeleği giymemişlerdi.
“İNANMAZSANIZ YAPAMAYABİLİRSİNİZ”
Burada konuşulması gereken şey hangi ekibin gittiği değil. Giden ekip hangisi olursa olsun. Bazen öyle şey vardır. Bazı şeyleri yapamayacağınıza inandığınız zaman psikolojik olarak da yapamayabilirsiniz. Bu bunun sizi yapamayacağınız, bilmediğiniz anlamına gelmez. Hangi personelin gittiği değil konu. Giden personel kalitesiyle, sertifikalarıyla, donanımlarıyla buna haiz mi? Gidilen bot bu anlamda, bu özelliklerde, teknik yapısıyla buna uygun mu buna bakmak lazım.
100 KERE DENESE 99’UNU BAŞARIRDI
Gemi kaptanı tek inisiyatifi olan kişidir. Gemisinin tek sorumlusu olan kişidir. O işi yapıp yapmayacağına karar verecek tek kişidir. Dolayısıyla da bu sürecin içinde gemi kaptanı tüm aşamalarını değerlendirmiş. Gemiyi de bu şekilde planlamış. Cemil Kaptan çok tecrübeli. Buradan 100 kere çıksa, 99’unu başarıyla yapacak kalitede birisi.
Anonometre 19 (Rüzgar ölçer) gösteriyor. Bu da 3-4 hava yani. Biz buna da inanmadık. Tekrardan bunları kriz masasında tüm ekibimizle tartışarak baktık. Dün Garipçe’deki meteoroloji sensörlerine de baktık. Rüzgar ne esmiş diye baktık. Bu da doğruluyor. Her şeyden önce konusuna vakıf gemi kaptanı. Kendisine her türlü inisiyatif verilmiş. O inisiyatifi değerlendirecek kalitede de bir arkadaşımız. Sonuçta o kararı da veren kendisi. Ona farklı bir şey söylemiş olmak, bu tip yakıştırmalarda bulunmak da çok hakkaniyetli değil.

Makine arızasını bilemiyoruz. Makine arızası da olabilir, başka bir şey de olabilir ama biz bunu inceleme sonunda göreceğiz. Bu operasyonları defaten yapmış. Mendirekten çok güzel bir şekilde çıkan bir kişinin, daha sonra sürüklenip kayalara gelip parçalanması söz konusu.
Olayı inceliyoruz. Mendirekten çıkışıyla ilgili sürece de bakacağız. Bizim tabi şu anda üzüntümüz sadece gerçekten binlerce kişiyi kurtaran böyle can siperane çalışan, hatta bu konuda ödül almış kaptanımız ve ekibinin kaybedilmiş olması bizi zaten son derece üzüyor.

10 SANİYE İÇİNDE OLMUŞ OLABİLİR
Kıyı Emniyeti Genel Müdürlüğü’nün kurucusu Hücum Tulgar, CNN Türk’te katıldığı canlı yayında yaşananları şöyle özetledi:
“Bu tekneler dünya üzerinde arama kurtarma teknelerindendir. Tüm teknik donanıma sahiptir.Personel eğitimli bir personeldir. Bu koşullarda çıkılır mı? Türk insanı dışında başkaları çıkmaz. Türkiye’de ‘çıkın’ diye talimat vermeyiz, ancak onların çıkmaması için ‘çıkmayın’ diye talimat verilir. Hava 8-9 şiddetinde bu tekneler 10-12 havada seyredebilen teknelerdir. Hacı yatmaz gibi denizde batma tehlikesi olmayan teknelerdir. Yalpaladığı zaman makineler 10 saniye kadar stop eder, o sırada makineler stop ettiği için kayalara vurmuş olabilir. Personele çıkmadı demek onlara haksızlık yapmaktır.”
DENİZ SAKİN MELTEM’Dİ
Rüzgârların şiddeti, Beaufort ölçeğinden yararlanılarak tahmin edilir. Bu ölçeği İngiliz Amiral Sir Francis Beaufort (1774-1857) savaş gemilerinde kullanılması amacıyla geliştirmiştir. Bu ölçekteki Beaufort sayısı ve ortalama rüzgâr hızı uluslararası değerlerdir; ama rüzgârların adı ve tanımlanan belirtileri ülkeden ülkeye değişebilir. Rüzgarın metre/saniye hızı skaladaki numaralarla karşılaştırılır. Denizciler bu yönteme göre denize çıkmaya karar verirler. Şile’deki kazada Beufort skalasına göre Sakin Meltem’de meydana geldi. Skaladaki tüm rüzgar hızları şöyle:
0 Sakin: Su yüzeyi ayna gibi düz, palpa liman. Karada yaprak kıpırdamaz. Duman dikine yükselir. Dalga Yüksekliği: 0 metre

10:21PM EST December 4. 2012 - Jessica Frend, government affairs adviser for a downtown Washington, D.C., law firm, was doing some holiday shopping last week at Tysons Corner, an upscale retail center in Northern Virginia.
As she was leaving the mall with her infant son to drive back to her home in Bethesda, Md., he started letting her know he was hungry. "I knew he would be needing to be fed pretty quickly," says Frend, 29. "I used my E-ZPass (transponder) and hopped on the 495 Express Lanes."
By using the new, real-time toll lanes, which opened Nov. 17, Frend figures she shaved about half the time off her trip — at a cost of 45 cents — and was able to feed her son before he got irritable.

That kind of reliable trip on highways that are continually growing more congested is one of the strongest selling points of the highway projects that some transportation specialists say are the future of urban tolling in the USA. These are lanes on highways, alongside free lanes, where people pay a fluctuating toll that rises as more drivers use the lanes and drops as demand falls off. Carpoolers, motorcyclists and bus passengers ride for free on most of them.
If a trip takes 20 minutes one day, 45 minutes the next, and 35 minutes the following day — because of varying road conditions and congestion — motorists must set aside 45 minutes for that trip each day to ensure that they're on time.
"The product we're selling Northern Virginia commuters is a faster and more reliable commute," says Jennifer Aument, vice president of corporate relations in North America for Transurban, one of two private firms that partnered with the Virginia Department of Transportation on the project along Interstate 495, known as the Capital Beltway. "It's not just about going faster, but it's also the reliability."
Aument says her firm, which manages the toll lanes, is contractually obligated to keep traffic moving at 45 mph. But "customers can expect to travel about 55 mph even during rush hour." Traffic sensors on poles along the road measure traffic conditions, including speed.
Another feature of this type of tolling: It helps ease congestion by attracting more commuters onto buses, where they know they can expect a reliable trip time, says Jim Ely, vice president of toll services for HNTB Corp., a national infrastructure firm.
In South Florida, where such toll lanes opened on Interstate 95 in 2010, bus ridership "has been wildly successful," says Jeff Weidner of the Florida Department of Transportation. "We have more than 5,000 rides a day, which is more than 2,500 people. That's 2,500 vehicles out of the traffic during the peak periods. And most of these are choice riders — 77% of them have access to a car."
The Northern Virginia toll lanes are a $1.9-billion, public-private venture featuring 14 miles of four "dynamic pricing" lanes on I-495.
Another new real-time tolling project opened Nov. 10 in Los Angeles County. L.A.'s first toll road is two lanes in each direction on an 11-mile stretch of Interstate 110, the Harbor Freeway. It's a one-year demonstration project sponsored by a $210-million federal grant, says Rick Jager, spokesman for the Los Angeles County Metropolitan Transportation Authority, known as Metro.
"So far, so good," Jager says. "When we opened, we had 30,000 (toll lane) transponders. Since then, that has grown to over 60,000." Metro allows carpools of two or more people, motorcycles and buses to use the lanes for free. Others pay a toll of 25 cents to $1.40 per mile. When speeds drop below 45 mph, the lanes are closed to solo drivers, Jager says.
Even some frequent critics of tolling on interstates like the fluctuating tolling. "It gives drivers another option," says Greg Cohen, president of the American Highway Users Alliance. "It's only feasible in very congested areas."
Bill Carbaugh, senior vice president of Guardian Realty in Bethesda, used the 495 Express lanes recently to get from a morning meeting in Tysons Corner, Va., back to his office.
"I'd use it for both work and personal trips," says Carbaugh, 48. "if I'm trying to get to the courthouse or a meeting, or if I'm trying to get to my son's basketball game or my daughter's basketball game. Normally, if I leave at 5, I would think I can get there in an hour. But with the traffic here, that's not enough sometimes. I would be willing to pay the toll to get there on time."

FRANKFURT — For all the talk about Germany’s financial exposure to Greece, it turns out that some German banks have a problem of more titanic proportions — their vulnerability to the global shipping trade.
Germany’s 10 largest banks have 98 billion euros, or $128 billion, in outstanding credit or other risks related to the global shipping industry, according to Moody’s Investors Service. That is more than double the value of their holdings of government debt from Greece, Ireland, Italy, Portugal and Spain. And it is more than any other country’s financial exposure to the shipping industry, which is in the fifth year of a recession.
Moreover, German banks bear a generous share of the blame for spawning that recession. By helping to finance and market funds used to build and buy ships, a popular tax shelter, the banks helped create a glut in large container ships that has led to a collapse in cargo hauling prices worldwide.
Germans grumble chronically about having to pay for Greece’s bad debts, and German policy makers style themselves as guardians of fiscal prudence. But the shipping-related crisis, and the threat it poses to the German economy from billions of euros in bad loans and losses at shipping-related companies, is a reminder that German banks and political leaders also have plenty to answer for.
The recession in shipping has been overshadowed by the euro zone debt crisis, but it has many of the same causes. They include complex financial products that turned sour, market-distorting government incentives and a gigantic underestimation of risk.
“The container ship market is completely overbuilt,” said Thomas Mattheis, a partner at TPW Todt, an accounting firm in Hamburg that advises clients in the industry. He attributed the situation to banks that granted easy credit, cargo companies that ordered too many vessels and investors eager for the tax-free profits that were part of the allure, thanks to German law.
“When you look back you can say they all had a share,” Mr. Mattheis said.
HSH Nordbank in Hamburg, the world’s largest provider of maritime finance, is expected to raise its estimate of potential losses from shipping on Wednesday when it reports quarterly earnings. The bank, owned by local governments and savings banks, has already warned that in coming years it will need to avail itself of 1.3 billion euros in guarantees offered by Hamburg and the state of Schleswig-Holstein, putting a further strain on taxpayers.
“I have to admit that grave mistakes were made in the years before 2009,” Constantin von Oesterreich, chief executive of HSH, said in an interview published on Saturday by The Hamburger Abendblatt. In October, Mr. von Oesterreich became the bank’s third chief executive since 2008.
Other German banks that were particularly active in ship finance, including Commerzbank in Frankfurt and NordLB in Hanover, which both rank in the top five globally in that market, have said they have made adequate provisions for losses and will not need any government aid.
Commerzbank, which is partly owned by the German government after a bailout, shut down a unit specializing in ship financing this year and is winding down its holdings. The bank warned in its most recent quarterly report that it would be at least another year before it could sell units that were set up to finance construction of cargo ships with names including Marseille and Palermo. While larger, relatively new cargo ships sell for tens of millions of dollars, older, smaller ships often fetch only a few million — not much more than the value of the scrap metal.
Exposure to shipping is one reason Moody’s affirmed its negative outlook for German banks last month. In a report, the ratings agency warned that the global shipping industry “faces weakened demand amid sluggish global economic growth and evolving structural overcapacity.” It said money that the 10 largest German banks had lent to the shipping industry equaled 60 percent of their capital, the funds held in reserve for potential losses.
The shipping crisis has already caused a string of bankruptcies worldwide. Last month, the Overseas Shipholding Group, based in New York, sought Chapter 11 bankruptcy protection. The company, which specializes in transporting oil and petroleum products, continues to operate while it seeks to restructure.
Last year, Beluga Reederei, a shipping company in Bremen, collapsed with the loss of about 550 jobs, according to The Weser-Kurier newspaper. Beluga’s majority owner was Oaktree Capital Management, an investment firm based in Los Angeles.
From a financial point of view, Germany has been hit especially hard by the shipping crisis because of the popularity of funds used to finance ship construction, as well as a tradition of ship finance by German banks. Ship funds, usually organized by specialized firms but often marketed and financed by banks, benefited from a law that taxes ships according to size, rather than revenue.
Any profits that ships generated were almost tax-free. But many investors did not realize that they would still be liable for paying the underlying tax on the ships, even if there were no profits. In some cases, they were even expected to repay past dividends to cover loan payments on money-losing ships.
These days, few are profitable. According to industry estimates, some 300 big container ships are idle in ports around the world for lack of customers.
“A lot of investors had no idea that there was a big risk in this investment segment,” said Jan-Henning Ahrens, a partner at KWAG, a law firm in Bremen that represents aggrieved investors.
Even if the industry recovers, which will take several more years at least, any revenue that ships generate will go to repay debt, Mr. Ahrens said. “The chances of getting money back are bad, if not zero,” he said.
Ship funds were originally conceived decades ago as a way to support employment in the shipping industry. Even after construction of most large ships moved to Asia in the 1990s, the tax breaks persevered and, theoretically, helped ensure employment for German crews as well as contracts for companies in northern Germany that supply services and technology to the industry.
Industry watchers agree that, with rare exceptions, ship funds have lost their appeal for years to come. Healthier shipping companies are taking advantage of the market to acquire vessels for little more than their scrap value.
And one of the big buyers, Costamare, is a Greek company.

ANKARA - Rekabet Kurulu, İstanbul Büyükşehir Belediyesi'nin (İBB) HAVAŞ'ın Senelik Ulaştırma Koordinasyon Merkezi izninin yenilememesiyle ilgili Rekabetin Korunması Hakkında Kanun kapsamında işlem yapılmasını gerek görmezken, Rekabet Kurumu Başkanlığını resen inceleme yapmakla görevlendirdi.
Rekabet Kurulu'nun resmi web sitesinde yapılan duyuruya göre, Kurul, İBB'nin kendi şirketi Havataş ile Havaalanları Yer Hizmetleri AŞ (HAVAŞ) arasındaki rekabeti önlemek amacıyla HAVAŞ'ın senelik Ulaştırma Koordinasyon Merkezi (UKOME) iznini yenilemeyerek faaliyetlerinin sona ermesine ve böylece tüketiciler açısından hizmette çeşitliliğin azalmasına sebep olduğu iddiasını gündemine aldı.
Dosya konusu iddialara yönelik olarak 4054 sayılı kanun kapsamında herhangi bir işlem yapılmasına gerek olmadığına karar veren kurul, ancak şikayet konusu ile ilgisi bulunan İBB tarafından ihale yolu ile İstanbul havalimanları-şehir merkezi ve aksi yönde toplu taşıma yapmak üzere belirli hatların 10 yıllığına kiralanması işleminin 1998/4 sayılı Tebliğ kapsamında bir özelleştirme işlemi olabileceği, bununla beraber, bu işlemin 1998/4 sayılı Tebliğe göre Rekabet Kurulu'na ön bildirim yapılması ve/veya izin alınması gereken bir işlem olup olmadığının ve ilgili pazarda yaratacağı olası etkilerin HAVAŞ tarafından başlatılmış olan idari yargı süreci takip edilerek sonucuna göre gerekirse Kanun'un 14. maddesindeki bilgi isteme yetkileri ile beraber yapılacak bir resen inceleme ile tespit edilmesi hususunda başkanlığın görevlendirilmesini oy birliğiyle kararlaştırdı.
Büyükdere Belediyesi'nin çok düşük bedelle yolcu taşımacılığı yaptığı iddiasını da ele alan kurul, düzenlenen rapora ve incelenen dosya kapsamına göre, dosya konusu iddialara yönelik olarak 4054 sayılı Kanun'un 41. maddesi uyarınca şikayetin reddi ile soruşturma açılmamasına oy birliğiyle karar verdi.
Remzi Cengiz Arsay isimli vatandaşın, hızlı kargo taşımacılığı sektöründe faaliyet gösteren teşebbüslerin aynı miktarda ordino ücreti talep ettiği ve bu hususun teşebbüsler arasındaki bir anlaşmadan kaynaklandığı iddiası üzerine ise kurul, dosya konusu iddialara yönelik olarak 4054 sayılı Kanun'un 41. maddesi uyarınca şikayetin reddi ile soruşturma açılmamasını oy birliği ile kararlaştırdı.

Bu yılın 11 ayında hizmet verilen toplam uçak trafiği 1 milyon 277 bin 851 oldu.


ANKARA - Havayolu yolcu sayısı, bu yılın 11 ayında, geçen yılın aynı dönemine göre yüzde 10,3 artarak, 122 milyon 433 bin 650 oldu. DHMİ, Kasım ayına ilişkin yolcu, yük ve uçuş istatistiklerini açıkladı. Buna göre, hava yolu yolcu sayısındaki artış, Kasım ayında da sürdü.
Bu yılın Kasım ayında uçak trafiği geçen yılın aynı ayına göre toplamda yüzde 3,6 artış gösterdi. Kasım ayında 46 bin 736'sı iç hat, 32 bin 897'si de dış hat olmak üzere toplam 79 bin 633 uçak trafiği gerçekleşti.
Türkiye hava sahasından üst geçiş (overflight) yapan 22 bin 545 uçak trafiğiyle bu yılın Kasım ayında hizmet verilen uçak sayısı 102 bin 178'e ulaştı. 2012 yılı Kasım ayı itibariyle iç hat yolcu sayısı geçen yılın Kasım ayına göre yüzde 5,2 artışla 5 milyon 38 bin 171 oldu. Kasım ayında iç hat yolcu sayısı, Antalya Havalimanı yüzde 16 artış gösterirken, Atatürk ve Adnan Menderes havalimanlarında yüzde 12'lik artış gerçekleşti.
2012 yılı Kasım ayında dış hat yolcu trafiği ise 2011 yılı aynı ayına göre yüzde 13,1 artışla 3 milyon 866 bin 286 oldu. İstanbul Atatürk Havalimanı'nın dış hat yolcu trafiği yüzde 24 artışla 2 milyon 484 bin 697'ye, toplam yolcu sayısı ise yüzde 20 artışla 3 milyon 709 bin 645'e çıktı.
Direkt transit yolcuyla toplam yolcu sayısı, Kasım ayında geçen yılın aynı dönemine göre yüzde 7,8 artarak 8 milyon 946 bin 353 oldu. Direkt transit yolcu dahil toplam yolcu trafiği, Kasım ayı sonu itibariyle, 122 milyon 433 bin 650 olarak gerçekleşti. Böylece bu yılın 11 ayında havayolunu kullanan yolcu sayısı, geçen yılın aynı dönemine göre yüzde 10,3 artmış oldu. 2011 yılının 11 ayında havayolunu kullanan yolcu sayısı 110 milyon 994 bin 749 olarak gerçekleşmişti.
Yük taşımacılığı
Bu yılın 11 ayında hizmet verilen toplam uçak trafiği, üst geçişler (Overflight) ile 1 milyon 277 bin 851 oldu. Yük (Kargo Posta Bagaj) trafiği ise 2 milyon 247 bin 691 tona ulaştı. 2012 yılı Kasım ayı itibariyle yük (Kargo Posta Bagaj) taşımacılığı dış hatlarda yüzde 8,3 artarak 120 bin 137 ton, toplamda da yüzde 3,1 artarak 167 bin 409 ton olarak gerçekleşti.

Çandarlı Limanı'na ilk gemi 2013'te

Türkiye'yi enerjinin ardından taşımacılıkta da doğu-batı hattının en önemli üslerinden biri yapacak olan Çandarlı Limanı’na ilk gemi 2013'te yanaşacak.

ANKARA - Türkiye'nin en büyük, dünyanın ise en büyük 10 konteyner limanlarından biri olacak Çandarlı Limanı'nda yüzde 65 oranında fiziki gerçekleşme sağlandı. Liman için yaklaşık 700 metre boyunda dalgakıran yapılırken, limana ilk gemi 2013 yılında yanaşacak. Türkiye'yi enerjinin ardından taşımacılıkta da doğu-batı hattının en önemli üslerinden biri yapacak olan Çandarlı Limanı, 15 bin kişiye istihdam sağlaması planlanıyor. Liman, artan trafiğe çözüm üretmesi açısından büyük önem taşıyor. Limanda fiziki gerçekleşme yüzde 65’e yaklaşırken, Ulaştırma, Denizcilik ve Haberleşme Bakanlığı, ilk gemiye 2013 yılında yanaştırmayı planlıyor.
Çandarlı Limanı Projesi, ana yük limanı olarak planlandığından 200 bin tonun üzerindeki gemilerin yanaşabileceği bir liman olma özelliğini taşıyacak. Çandarlı Limanı'nın ihalesi mart ayında yapılmış ihaleye en düşük teklifi 196 milyon 200 bin TL ile Cengiz ve Makyol Ortak Girişim Grubu vermişti.
700 milyon TL'lik gelir
Ulaştırma, Denizcilik ve Haberleşme Bakanlığı yetkilileri, liman projesi tamamlandığında, limanın arka bölgesinde endüstriyel alan doğacağını belirterek, ticaret olanaklarının artacağını, ulaşım tesisleri ve olanakları gelişeceğini kaydetti. Projenin Zeytindağ, Çandarlı, Yenişakran ve Aliağa ile tüm Ege Bölgesi'ni gerek istihdam, gerekse üretim açısından olumlu yönde etkileyeceğinin altını çizen yetkililer, bu limanın, hem İzmir'in hem de Türkiye'nin kazanmasını sağlayacak büyük bir yatırım olduğunu, limanın İzmir'e yıllık 700 milyon lira gelir getireceğini aktardı.
Türkiye'nin en büyük limanlarının özellikleri

Mersin Limanı: 21 tane rıhtımı bulunan limanda, büyüklüğüne göre aynı anda 30'a yakın gemiye yükleme- boşaltma hizmeti veriliyor. Yılda ortalama 15 milyon ton yük elleçlemesi yapılıyor.
Ambarlı Limanı: Türkiye'nin en büyük limanı olma özelliğini koruyan Ambarlı Limanı'nda 2009 yılında konteynerli yük hareketi 1.9 milyon TEU'ya ulaştı.
Bandırma Limanı: Halen özelleştirmesi gündemde olan limanı'nın yük elleçleme kapasitesi 2 milyon 771 bin ton. 2 bin 788 metre rıhtım uzunluğuvar. Yılda 4 bin 280 gemi kabul edebiliyor. TMO'ya ait 34 bin ton kapasitesi bir hububat silosuna sahip.
İskenderun Limanı: 1.426 metre rıhtım uzunluğuna ve yılda 640 gemi kabul kapasitesine sahip bulunuyor.
Samsun Limanı: Bin 756 metre rıhtım uzunluğuna sahip liman yılda bin 130 gemi kabul edebiliyor. Rıhtım kapasitesi ise 2 milyon 380 bin ton/yıl olarak biliniyor.
İzmir Limanı: Batı Avrupa ile Kuzey Afrika arasında bulunan İzmir Limanı’nda altyapı, ekipman, karışık eşya, dökme katı, sıvı yük yükleme ve boşaltma, Ro-Ro ve yolcu hizmetleri veriliyor. 2 bin 959 metre rıhtım uzunluğu bulunan İzmir Limanı yılda 3 bin 640 gemi kabul edebiliyor.
Derince Limanı: İzmit Sanayi hinterlandının ithalat ve ihracat kapısı olarak kabul edilen Derince Limanı'ndan Romanya'nın Köstence Limanı'na da taşımacılık yapılıyor. Bin 92 metre rıhtım uzunluğu var. Yıllık gemi kapasitesi ise 862. Liman otomotiv sektörünün bulunduğu bölgeye yakınlığı ile de dikkat çekiyor.
Trabzon Limanı: Yıllık 5 milyon ton kapasite ve 3.5 ton depolama alanıyla Doğu Karadeniz Bölgesi'nin en büyük limanı. 2009’da bin 242 gemiye hizmet verildi. Yine 2009’da limandan 21 bin adet konteyner yüklemesi ve boşaltması yapıldı.
Haydarpaşa Limanı: Türkiye'nin Mersin ve İzmir Limanı'ndan sonra üçüncü büyük limanı olan Haydarpaşa Limanı, Marmara Bölgesi'ndeki en büyük konteyner limanı özelliğini koruyor. Limandaki konteyner kara terminalinin alanı 55 bin m2, yıllık tutma kapasitesi ise 52 bin 800 TEU.

About OSHA

Safety in American warehouses is regulated by a series of standards from the Occupational Safety and Health Administration, commonly known as OHSA. The US Congress created OSHA under the Occupational Safety and Health Act, which was signed into law by President Nixon on December 29, 1970. The main focus of OSHA is to prevent work-related injuries, illnesses, and deaths. Since the administration began, occupational deaths have been cut by 62% and injuries have declined by 42%. However, the fatal injury rate for the warehousing industry is higher than the national average for all industries.
At a federal level OHSA inspects about 40,000 facilities per year, while the 26 state operated OHSA organizations inspect another 60,000. OHSA can issue citations which result in financial penalties up to $7,000 for non-serious violations, but can rise to $70,000 for repeat offenders.

OSHA issues many publications on safety issues in a warehouse and the solutions that can be adopted by businesses to reduce accidents and minimize injury. The list below is their top 10 areas for which they issue citations.

Forklifts

Forklifts can be dangerous, OSHA records about 100 warehouse employees are killed and 95,000 injured every year in forklift accidents while operating forklifts. The majority of fatalities are caused by forklift turnovers. Being crushed between a forklift and another surface is the second highest percentage, followed by getting struck a forklift and then getting hit by falling material from a dropped load.
OHSA issue guidelines on forklift operation including the following:
  • Train, evaluate and certify all operators to ensure that they can operate forklifts safely, follow safe procedures for picking up, putting down and stacking loads
  • Drive safely and never exceeding 5 mph and slow down in congested areas,
  • Maintain sufficiently safe clearances for aisles and at loading docks or passages where forklifts are used
  • Train employees on the hazards associated with the combustion byproducts of forklift operation, such as carbon monoxide.

Hazard Communication

Hazard communication refers to the information about chemical hazards and the associated protective measures that is communicated to employees and employers. Chemicals pose a wide range of health hazards, such as irritation, and physical hazards, such as flammability and corrosion. Chemical manufacturers and importers to evaluate the hazards of the chemicals they produce or import; and providing information about them through labels on shipped containers and more detailed information sheets called material data safety sheets (MSDS).
OSHA recommend a number of measure with regards to Hazard communication:{
  • Employees should be trained on the risks of each chemical being stored.
  • Provide spill cleanup kits in any area where chemicals are stored.
  • Have a written spill control plan.
  • Train employees to clean up spills, protect themselves and properly dispose of used materials.
  • Provide proper personal protective equipment and enforce its use.
  • Store all chemicals safely and securely.

Electrical Safety

Many times electrical hazards are the cause of injuries and fatalities in the workplace. As well as being dangerous in a warehouse it is one of the leading causes of accidents in construction sites. The first step towards electrical safety is controlling or eliminating factors in your warehouse that pose electrical hazards. Ground fault electrical shock is a common electrical hazard. OSHA requires that employers provide ground fault circuit interrupters (GFCIs) for receptacle outlets. Warehouses should provide assured equipment grounding conductor program. Either of these methods can eliminate hazards in ground fault electric shock.

Guarding Floor And Wall Openings and Holes

The easiest way to avoid falls in the warehouse is by eliminating and controlling fall hazards. This can be achieved by the use of fall protection equipment or devices. There are basically two types of fall protection. With a combination of both, you can ensure a safer environment for employees who are exposed to fall hazards.
One type of fall protection is the fall restraint; these systems consist of equipment that prevent a free fall, for example guardrails/standard railings, full body harness, and warning lines. The other type is the fall arrest, these systems help by stopping a fall in progress or saving an employee in the middle of a fall, for example the use of safety nets.

Respiratory Protection

Many accidents occur each year and most of the time it’s because of the absence or lack of personal protective equipment (PPE). OSHA strictly regulates employers to provide their employees with proper PPE. Many accidents occur not because of absence or lack of PPE but because employees do not to wear it. This is particularly true of respiratory protection. In some warehouses there is the presence of toxic airborne substances. This is where respirators should be used by employees.
Respiratory protection is designed to protect the wearer from dust, fumes, paint spray, pesticides and other substances that could bring about long-term or permanent impairment or even death. As with other types of PPE, safety programs provided to warehouse employees must specify the proper ways to clean, maintain and repair respirators.

Lockout/Tagout

In the warehouse there is often defective or damaged equipment. It is important that these items are tagged with an “Out of Service” until it gets replaced or repaired. This will keep employees away from items that may cause serious injury or illness. According to OSHA, tag is “a device usually made of card, pasteboard, plastic or other material used to identify a hazardous condition”. Many companies are cited by OSHA because tags are not used in the correct way.
